By accessing, browsing, or using the Website or Service in any manner, including anonymous use or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Website or Service.

We reserve the right to modify these Terms at any time. We will post the revised Terms on the Website and update the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

Svg.onl provides an online platform that allows users to generate Scalable Vector Graphics (SVG) based on text prompts using artificial intelligence algorithms. The Service operates on a coins-based system, with different features and limitations available depending on whether you are an anonymous user, a free registered user, or a paid subscriber.

3. User Accounts

To access certain features, such as increased coins limits and private SVG generation, you may need to register for an account. When you register, you agree to:

• Provide accurate, current, and complete information as prompted by the registration form.
• Maintain and promptly update your registration data to keep it accurate, current, and complete.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or otherwise suspect any security breaches related to the Service or your account.

You are responsible for all activities that occur under your account.

4. Anonymous Use

You may use certain features of the Service without creating an account ("Anonymous Use"). To manage usage limits and preferences for anonymous users, we utilize browser fingerprinting technology, as described in our Privacy Policy. By using the Service anonymously, you consent to this practice.

Anonymous users are subject to specific limitations, including lower coins allowances and potentially public visibility of generated SVGs.

5. Coins and Payments

The Service operates on a coins system. Each SVG generation consumes a specific number of coins.

• Free Coins: Registered users on the free tier and anonymous users (subject to identification) receive a limited number of free coins daily or periodically, as specified on the Website. Unused free coins typically do not roll over.
• Paid Coins: Users can purchase coins granting additional features (e.g., private SVG generation).
• Payments: Payments for coins are processed through our third-party payment processor (Gumroad). By purchasing, you agree to their terms and conditions.
• Refunds: Please see our Refund Policy detailed in Section 11 below.
• Bonus Codes: We may offer bonus codes (e.g., via Etsy purchases) redeemable for coins.

6. User Conduct

You agree not to use the Service to create, upload, post, email, transmit, or otherwise make available any content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
• Infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
• Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
• Attempts to circumvent usage limits or abuse the coins system;
• Interferes with or disrupts the Service or servers or networks connected to the Service.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from the Service, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.

7. Content Ownership and Licenses

Your Generated Content: You retain ownership of the copyrights and other intellectual property rights in the SVGs you generate using the Service ("Generated Content"), subject to the licenses granted below and any underlying rights of third parties in the data used by the AI model.

License Grant to Us: By generating content, you grant svg.onl a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Generated Content solely in connection with operating, providing, and improving the Service. This includes storing your Generated Content and making it available to you through your account.

Public Visibility: For users on the Free tier, Generated Content is set to be publicly visible by default. By using the Free tier, you grant svg.onl the right to display this publicly visible Generated Content in public galleries, promotional materials, and other parts of the Service accessible to other users and the public. Users on paid subscription tiers have their Generated Content set to private by default.

Verification: We reserve the right, particularly for publicly visible content, to review and verify Generated Content (`verified` flag). We may choose to approve, discard (mark as verified but not publicly visible), or remove content that violates these Terms or our content policies in our sole discretion.

Our Content: The Website and its original content (excluding Generated Content), features, and functionality are and will remain the exclusive property of svg.onl and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SVG.ONL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. THE QUALITY, ACCURACY, OR ORIGINALITY OF ANY SVGS GENERATED THROUGH THE SERVICE IS NOT GUARANTEED. AI-GENERATED CONTENT MAY BE SIMILAR TO OR IDENTICAL TO CONTENT GENERATED FOR OTHER USERS OR EXISTING WORKS.

YOU ARE SOLELY RESPONSIBLE FOR VERIFYING THAT YOUR USE OF ANY GENERATED CONTENT DOES NOT INFRINGE ON ANY THIRD-PARTY RIGHTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SVG.ONL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Indemnification

You agree to defend, indemnify, and hold harmless svg.onl and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

11. Refund Policy

Generally, all purchases of coins are final and non-refundable.

Exceptions may be made only if required by applicable consumer law in your jurisdiction or in cases of documented technical failure preventing use of the Service, evaluated on a case-by-case basis at our sole discretion.

To request consideration for a refund under an exception, please contact us with detailed information about the issue.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion. Paid subscription cancellations are governed by the terms specified during purchase and potentially managed via our payment processor's portal.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

14. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Entire Agreement

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
